You know it is counterfeit and should QUESTION the Seller when…
- You can purchase a collection of 100,000 embroidery designs for $9.99. The retail value on a collection of 20,000 designs is $5,000.00.
- You receive a blank CD with the words “designs” written across it with a marker
- You do not receive any literature or color charts
- Seller tells you it is a copy
- Seller does not advertise that he is an Authorized Dealer
- Seller does not advertise that he holds the copyrights to the designs or software
- Multiple copies are available for any auction
- Receive a “Second Chance” offer from the Seller
- You recognize the designs from your local retail store
- If the deal or price sounds too good to be true, IT IS
End users searching for free or substantially discounted embroidery designs are in danger of purchasing pirated or counterfeit embroidery designs. It is the responsibility of the buyer to investigate and question any seller of embroidery designs and software.
Ask questions to avoid problems down the road. Beware of “too good to resist pricing.” Retail prices for embroidery designs from the National Retailers normally range from $50.00 to $150.00 for a collection of 20 designs. Independent artists and digitizers sell collections for less but when internet or online auction pricing ranges from $5.00 to $15.00 for a collection of hundreds or thousands of designs, it’s reasonable to assume the designs are counterfeit and the Seller should be questioned.

- Embroidering any item for personal use.
- The right to install it on one computer or sewing machine of your choice.
- Modify size and color of designs for personal preference.
- Licensed designs (like Sesame Street, Disney, Precious Moments, etc.) may be stitched out on garments and items for personal use only.
- Restrictions involving sale of sewn out designs may be prohibited. Check packaging for copyright information.
Legal uses of embroidery designs:
When you purchase embroidery design software, you are authorized to embroider any garment that includes the sewn out design. Some generic designs may include restrictions on selling the garment. If the design is licensed (i.e. Sesame Street®, Disney®, Precious Moments®, etc.), you may not sell the garment with the sewn out design at any time. Although many software design packages enable you to modify the size and color of designs, you are not authorized to distribute the modified designs as computer files to others. Check the design package or manufacturer for more information.
